THE SINDH REGULARIZATION OF TEACHERS APPOINTED ON CONTRACT BASIS ACT, 2018
SINDH ACT NO. XVII OF 2018
AN ACT
To provide for regularization of the services of certain teachers appointed on contract basis in the year 2014 through the National Testing Service (NTS) under the Teacher Recruitment Policy
(TRP) 2012 and Sindh University under TRP-2008.
WHEREAS it is expedient to provide for regularization of the services of certain teachers appointed on contract basis in the year 2014 through the National Testing Service (NTS) under the Teacher Recruitment Policy (TRP) 2012 and Sindh University under TRP2008 and to provide for matters connected therewith or ancillary thereto;
Preamble.
1. (1) This Act may be called the Sindh Regularization of Teachers appointed on Contract Basis Act, 2018.
(2) It shall come into force at once.
Short title and commencement.
2. (1) In this Act, unless context otherwise requires - (a) “Act” means the Sindh Civil Servants Act,1973;
(b) “appointment of a teacher on contract basis” means the appointment of a duly qualified teacher made on contract basis;
(c) “civil servant” shall have the same meaning as assigned to it in the Act;
(d) “Government” means the Government of Sindh;
(e) “teacher” means a person appointed as primary, junior and high school teacher through to provide for regularization of the services of certain teachers appointed on contract basis in the year 2014 through the National Testing Service (NTS) under the Teacher Recruitment Policy (TRP) 2012 and Sindh University under TRP-2008.
Definitions
3. Notwithstanding anything contained in the Act or rules made thereunder or any decree, order or judgment of a court, but subject to other provisions of this Act, a teacher appointed on contract basis and holding such appointment on the commencement of this Act, shall be deemed to have been validly appointed as teacher as a civil servant on regular basis, with effect from the date of commencement of this Act:
Provided that the orders of the regularization of services of a teacher shall be issued by the appointing authority subject to verification of his performance by Reform Support Unit of School Education and Literacy Department, Government of Sindh:
Provided further that the services of a teacher shall not be regularized unless he has completed or completes three years of his contract period and who does not possess the qualifications prescribed for the post and his performance is not satisfactory:
Provided also that the transfer of any teacher, whose service is regularized, shall be allowed only on the condition that it shall not have any adverse effect on the working of that school and shall not disturb the specified Student Teacher Ratio (STR).
